ایام مرخصی از جمله موضوعات حیاتی و حایز اهمیت در طول خدمت هر کارگری است و استفاده از آن به اشکال متعدد و با داشتن شرایطی در قانون دیده شده است. قانون کار ایران از ماده ۶۲ تا ۷۸ به مبحث تعطیلات و مرخصی کارگران شاغل پرداخته است.
ماده ۶۲ قانون کار
روز جمعه، روز تعطیل هفتگی کارگران با استفاده از مزد است.
ماده ۶۳ قانون کار
کارگران علاوه بر تمام تعطیلات رسمی کشور، یک روز دیگر هم تعطیلند و آن تعطیلی ۱۱ اردیبهشت، روز کارگر است که کارفرمایان نباید در این روز کارگران را به خدمت بگیرند یا وادار به کار کنند. ضمن آنکه حقوق و دستمزد و اضافه کار روز تعطیل کارگر باید محاسبه شود.
ماده ۶۴ قانون کار
مرخصی استحقاقی سالانه کارگران با استفاده از مزد و محاسبه چهار روز جمعه، جمعا یک ماه است. سایر روزهای تعطیل جزو ایام مرخصی محسوب نمی‌شود و برای کار کمتر از یک سال مرخصی مزبور به نسبت مدت کار انجام یافته محاسبه می‌شود.
ماده ۶۵ قانون کار
در مورد کارگران “مشاغل سخت و زیان‌آور” قانونگذار مرخصی سالیانه را پنج هفته در نظر گرفته که استفاده از این مرخصی حتی الامکان در دو نوبت در پایان هر شش ماه کار صورت می گیرد.
ماده ۶۶ قانون کار
کارگر نمی‌تواند بیش از ۹ روز از مرخصی سالانه خود را ذخیره کند .
ماده ۶۸ قانون کار
میزان مرخصی استحقاقی کارگران فصلی بر حسب ماه‌های کارکرد تعیین می‌شود .
ماده ۶۹ قانون کار
تاریخ استفاده از مرخصی با توافق کارگر و کارفرما تعیین می‌شود و درصورت اختلاف بین کارگر و کارفرما، نظر ادارات کار تعیین کننده و لازم الاجراست.
ماده ۷۰ قانون کار
مرخصی کمتر از یک روز کار جزو مرخصی استحقاقی منظور می‌شود. در برخی ادارات و سازمان‌ها عنوان “مرخصی کمتر از دو ساعت و سه ساعت” برای انجام کارهای ضروری کارگران تعریف شده که بیش از آن، مرخصی یک روز کامل محاسبه می‌شود.
ماده ۷۱ قانون کار
این ماده درخصوص کارگرانی پیش‌بینی شده که قرارداد کارشان فسخ شده یا پایان یافته، یا دچار از کار افتادگی کلی و یا مشمول بازنشستگی شده‌اند. مطالبات مربوط به مدت مرخصی استحقاقی این دسته کارگران در چنین شرایطی به آنها و در صورت فوت به وراث تعلق می‌گیرد.
ماده ۷۲ قانون کار
نحوه استفاده از مرخصی بدون حقوق کارگران و مدت آن و شرایط برگشت آنها به کار پس از استفاده از مرخصی با توافق کتبی کارگر یا نماینده قانونی او و کارفرما تعیین خواهد شد .
ماده ۷۳ قانون کار
این ماده به مرخصی‌های ارفاقی کارگران اشاره دارد و متاثر از حوادث و اتفاقات زندگی آنها است که بعضا از آن به عنوان “مرخصی اضطراری” یاد می‌شود. در موارد خاص نظیر ازدواج دائم یا شرایط اضطرار نظیر فوت بستگان نزدیک و درجه یک و یا مواجه با حوادث غیر مترقبه اعم از زلزله و آتش سوزی، کارگران مشمول قانون کار حق بهره‌مندی از سه روز مرخصی با حقوق بدون کسر از مرخصی سالیانه را دارند.
ماده ۷۴ قانون کار
یکی از مرخصی‌های چالش برانگیز کارگران، مرخصی استعلاجی است که باید به تایید سازمان تامین اجتماعی برسد. در قانون کار هیچ محدودیتی برای گرفتن مرخصی استعلاجی کارگران مشمول قانون کار پیش‌بینی نشده و به هر میزان که پزشک معالج تجویز کرده باشد، امکان استفاده از مرخصی استعلاجی وجود دارد، منتها این نوع مرخصی اعم از کوتاه مدت یا بلندمدت تابع ضوابط و مقررات قانون تامین اجتماعی است، به نحوی که مدت مرخصی استعلاجی باید توسط پزشک معتمد و معالج و یا کمیسیون پزشکی سازمان تامین اجتماعی تایید شود تا هم جزو سوابق کار و بازنشستگی کارگران به شمار آید و هم مشمول پرداخت غرامت و دستمزد شود.
در قانون کار جمهوری اسلامی ایران انواع دیگری از مرخصی‌ها برای برخی شرایط خاص تعریف شده است.
مرخصی بدون حقوق
در ماده ۱۶ قانون کار، استفاده از مرخصی بدون حقوق تجویز شده است منتها این مرخصی باید با موافقت کارفرما صورت بگیرد چون نظر قانونگذار درخصوص قرارداد کارگرانی که مطابق این قانون از مرخصی تحصیلی یا دیگر مرخصی‌های بدون حقوق استفاده می‌کنند، این است که قرارداد کار به حال تعلیق درآید و پس از آن کارگر به کار سابق بازگردد.
موارد استفاده از مرخصی بدون حقوق شامل تحصیل، انجام سفرهای طولانی، امور شخصی، گرفتاری‌های خانوادگی، تغییر کار و گذراندن دوره آزمایشی برای کار جدید است. مرخصی بدون حقوق حداکثر دو سال است که در صورت استفاده از مرخصی تحصیلی، به مدت دو سال دیگر قابل تمدید است.
مرخصی کارگران روزمزد
به موجب ماده ۴۳ قانون کار، کارگران کارمزد برای روزهای جمعه و تعطیلات رسمی و مرخصی، استحقاق دریافت مزد را دارند و مأخذ محاسبه میانگین کارمزد آنها در روزهای کارکرد، آخرین ماه کار آنهاست. مبلغ پرداختی هم نباید کمتر از حداقل مزد قانونی باشد.
مرخصی حج واجب
بر اساس ماده ۶۷ قانون کار هر کارگر حق دارد در تمام مدت کار خود تنها برای یک نوبت به منظور ادای فریضه حج واجب (تمتع) یک ماه مرخصی بگیرد. کارگر می‌تواند از ۳۰ روز مرخصی تحت عنوان “مرخصی استحقاقی” به شرطی که ۳۰ روز مرخصی ذخیره داشته باشد، بهره‌مند شود و چنانچه مرخصی طلب نداشته باشد از “مرخصی بدون حقوق” استفاده کند.
مرخصی زایمان و بارداری
در ماده ۷۶ قانون کار، مرخصی بارداری و زایمان کارگران زن جمعاً 180 روز پیش‌بینی شده است که حتی‌الامکان ۴۵ روز از این مرخصی باید پس از زایمان مورد استفاده قرارگیرد. برای زایمان توأمان ۱۴ روز به مدت مرخصی اضافه می‌شود. در این ماده تاکید شده که پس از پایان مرخصی زایمان، زنان کارگر باید به کار سابق خود بازگردند و این مدت با تأیید سازمان تأمین اجتماعی جزود سوابق خدمت آنها محسوب شود. البته حقوق ایام مرخصی زایمان طبق مقررات قانون تأمین اجتماعی پرداخت خواهد شد.
کمک‌هزینه بارداری در ایام مرخصی زایمان
مرخصی زایمان به همۀ زنان شاغل تعلق می‌گیرد، اما دریافت کمک‌هزینۀ بارداری در شرکت‌های خصوصی مطابق قوانین تأمین اجتماعی است و در برخی از شرکت‌های دولتی نیز بر اساس بخش‌نامه‌های داخلی عمل خواهد شد. کمک هزینۀ بارداری برای زنان شاغل تحت پوشش تأمین اجتماعی در موارد زیر پرداخت می‌شود:
-
در یک سال گذشته، حداقل ۶۰ روز کاری حق بیمه پرداخت کرده باشد.
-
در مدت مرخصی، مشغول به کار نباشد و دستمزدی دریافت نکند.
-
در زمان تقاضای مرخصی، مشغول به کار یا در مرخصی استحقاقی باشد.
-
زایمان مربوط به فرزند چهارم به بعد نباشد.
در حال حاضر تأمین اجتماعی تنها کمک‌هزینۀ بارداری برای مدت شش ماه را پرداخت می‌کند. مبلغ این کمک‌هزینه بر اساس مبلغ دستمزدی محاسبه می‌شود که مبنای محاسبۀ حق بیمۀ شماست. اگر شرکت شما دستمزدی بیشتر از آنچه در لیست بیمه به تأمین اجتماعی اعلام شده است به شما پرداخت می‌کند، ملاک محاسبۀ کمک‌هزینۀ بارداری مبلغ اعلام‌شده به تأمین اجتماعی است. اگر در جریان دستمزدی نیستید که توسط شرکت به تأمین اجتماعی اعلام می‌شود، می‌توانید از بخش منابع انسانی شرکت در مورد آن سؤال کنید.
طبق قوانین تأمین اجتماعی، کمک‌هزینۀ بارداری معادل دو سوم آخرین دستمزد شخص است. آخرین حقوق بر اساس میانگین سه ماه آخر آن بخش از حقوق که حق بیمه از آن کسر می‌شود محاسبه خواهد شد. درصورتی‌که مادر باردار بنا به تشخیص پزشک، نیاز به استراحت یا درمان داشته باشد و مطابق قانون، مشمول استفاده از مرخصی استعلاجی باشد، تأمین اجتماعی مبلغی را به عنوان غرامت دستمزد ایام بیماری به شخص بیمه‌شده پرداخت خواهد کرد. مادران شاغل تحت پوشش تأمین اجتماعی برای دریافت کمک‌هزینۀ بارداری یا غرامت دستمزد ایام بیماری باید با در دست داشتن مدارک شامل اصل دفترچۀ بیمه و گواهی پزشک معتبر به شعبۀ سازمان تأمین اجتماعی مراجعه کنند. تأمین اجتماعی معمولاً مبلغ کمک‌هزینۀ بارداری و سایر هزینه‌ها را در یک نوبت و در پایان دوره به حساب شما پرداخت خواهد کرد.
مرخصی اجباری!
در سالهای اخیر عنوان” مرخصی اجباری” باب شده است اما این مرخصی در نه تنها در قانون کار بلکه در هیچ یک از قوانین استخدامی و قوانین حمایتی کشور پیش‌بینی نشده است. اصطلاح مرخصی اجباری از زمانی وارد حیطه روابط کار شد که کارخانه‌ها، بنگاه‌ها و کارگاه‌ها گرفتار بحران اقتصادی و رکود و تعطیلی شده و به ناچار به توقف خط تولید یا شیفتهای کاری تن دادند. مرخصی‌های اجباری نوروزی یا تابستانی کارگران نیز از این موضوع تبعیت می‌کند و چون تعطیلی ناشی از اراده کارفرماست موظف به پرداخت تمام حقوق و دستمزد و مطالبات کارگران است.
